A Separation Agreement, also known as a Minute of Agreement, is a legally binding contract that records what you and your partner agree upon when separating. This can cover everything that matters most to you, including:
- Care and contact arrangements for your children
- The transfer or sale of property
- Financial support for you or your children
- Payment of a capital lump sum
- Pension-sharing agreement
- Define your matrimonial property (assets and debts acquired during your relationship) and provide guidance on fair division.
- Include arrangements in your Minute of Agreement for what happens in the event of either party’s death.
- Review or update your Will, Power of Attorney, and pension nominations to ensure your wishes are protected.
- Advise on business matters if you and your partner own a business together, including tax, employment, and succession rights.
