A Power of Attorney (PoA) is a legal document that lets you choose someone you trust - known as your attorney - to make decisions on your behalf if you are unable to do so yourself. Types of Power of Attorney

In Scotland, there are two main types:

  • Continuing (Financial) Power of Attorney – this allows your attorney to manage your money and property, including bank accounts, bills, investments, or your home.
  • Welfare Power of Attorney – this allows your attorney make decisions about your personal welfare, such as healthcare, medical treatment, and daily care.

How it works

You choose who will act as your attorney and outline the powers they have. You can appoint more than one attorney and decide whether they act together or independently. The document is registered with the Office of the Public Guardian (Scotland) to ensure it is valid and legally binding.
