Problem

Our clients’ young son was catastrophically injured in a car crash leaving him tetraplegic and ventilator dependent. The accident was caused by a foreign driver being on the wrong side of the road. The family lived in a historic property on the coast which was incapable of adaptation for their son’s needs.

Our Fiona Mundy represented the family in proceedings in the Court of Session. The whole process of recovering damages lasted over 8 years and involved the instruction of numerous professionals to obtain very specialist advice. Our clients were awarded interim damages which enabled them to purchase land to build a new home for the family and put a care package in place for their son.

Outcome

Our clients received what was at that time the largest award of damages ever made in Scotland worth many millions of pounds. They were advised to set up a Trust to invest and manage the damages for their son who is now in his mid-twenties. He has obtained a degree and lives independently from his parents in a property purchased and adapted for him. He hopes to set up his own business shortly. Fiona Mundy continues to work with the family as a professional Trustee  of the Trust assisting with all manner of issues which continue to affect the family.
