Adoption

Adoption gives a child new legal parents but also under the current Law ends the legal relationship between the child and birth parent(s), so there are no continuing parental rights and responsibilities. In deciding to adopt a child there are very strict steps that are undertaken by the adoptive parent(s) in the Sheriff Court.

The action for adoption is raised by a Court document known as a “petition”. The child(ren) are appointed a curator ( think – guardian) by the Court and the local Social Work Department or Family Team appoints a trained Social Worker to prepare an in depth report into the circumstances of all the relevant people concerned for the Court.

A lot of adoptions are unopposed but can become more complicated if either or both parents object.
